Legal notice

In accordance with articles 6-III and 19 of French Act no. 2004-575 of 21 June 2004 on confidence in the digital economy ("LCEN"), the following legal notice is provided to users and visitors of https://ticket.e-cosplay.fr (hereinafter "the Platform"). This is a courtesy translation; the French version prevails.

1. Publisher of the Platform

The E-Ticket Platform is published and operated by:

2. Hosting and technical providers

The Platform is hosted by:

Amazon Web Services EMEA SARL

  • 38 avenue John F. Kennedy, L-1855 Luxembourg
  • Hosting region: eu-west-3 (Paris, France) — servers and backups located in France
  • Website: aws.amazon.com

Additional technical services:

  • Cloudflare, Inc. — security, denial-of-service protection and content delivery (101 Townsend St, San Francisco, CA 94107, USA)
  • Amazon Web Services EMEA SARL (Amazon SES) — transactional email delivery (order confirmations, tickets), eu-west-3 region
  • Stripe Payments Europe, Ltd. — payment service provider for ticket sales and payouts to organisers (The One Building, 1 Grand Canal Street Lower, Dublin 2, Ireland). An electronic money institution authorised by the Central Bank of Ireland. Card data (card number, security code) is collected and processed solely by Stripe, in a PCI-DSS certified environment: it never passes through the association's servers.

3. Purpose of the Platform

The Platform https://ticket.e-cosplay.fr is an online ticketing service made available to non-profits and event organisers. Its purposes include:

  • selling and issuing admission tickets for events (conventions, festivals, shows, parties, workshops);
  • booking stalls and tables (flea markets, car boot sales, craft markets);
  • running online votes as part of competitions;
  • issuing free invitations, staff and exhibitor passes, and partner passes;
  • checking people in by scanning a QR code;
  • tracking sales, payments and payouts on behalf of organisers.

4. Role of the Platform and organiser responsibility

E-Ticket acts as a technical intermediary between the organiser of an event and the buyer of a ticket.

  • The organiser is solely responsible for their event: programme, content, prices, admission conditions, specific sales terms, running of the event, cancellation, postponement and refunds.
  • Association E-Cosplay does not organise events published by third parties, except where it is itself the organiser, which is then stated on the event page.
  • Any complaint about an event, a ticket or a refund must be addressed directly to the organiser, whose contact details appear on the event page and on the ticket.
  • Payments are collected into the organiser's own payment account held with Stripe. The association receives a service commission, detailed on the pricing page and in the general terms.

5. Access to the Platform and technical requirements

Association E-Cosplay uses reasonable means to provide quality access to the Platform, but is bound only by an obligation of means, not of result.

To use the Platform under proper conditions, users need:

  • a recent, up-to-date web browser (Firefox, Chrome, Edge, Safari — latest stable versions);
  • a stable internet connection;
  • a device compatible with modern web standards (HTML5, CSS3, JavaScript ES2020+);
  • JavaScript enabled in order to use all features, in particular payment and check-in;
  • to accept the cookies strictly necessary for the service to work;
  • for check-in, a device with a camera and permission to use it.

The association cannot guarantee that the Platform will work on obsolete or non-standard configurations. Access may be interrupted at any time, without notice, in particular for maintenance, updates, security, or in the event of force majeure as defined by article 1218 of the French Civil Code and French case law. The association cannot be held liable for the consequences of such interruptions.

6. Intellectual property

All items available on the Platform (structure, texts, logos, images, illustrations, graphics, icons, software, databases, trade marks and domain names) are protected by the French Intellectual Property Code, in particular articles L.111-1 et seq. (copyright) and L.335-2 et seq. (infringement).

Association E-Cosplay owns the intellectual property rights, or holds the rights of use, in the items it publishes. Event artwork, posters, texts and trade marks remain the property of their respective organisers, who warrant that they hold all rights required to publish them on the Platform and indemnify the association against any claim in this respect.

Any reproduction, representation, modification, publication, adaptation or exploitation, commercial or otherwise, of all or part of the Platform, by any means whatsoever, is prohibited without the prior written consent of Association E-Cosplay or of the relevant rights holder.

Any unauthorised use will be treated as infringement and prosecuted under articles L.335-2 et seq. of the French Intellectual Property Code, punishable by three years' imprisonment and a fine of €300,000.

Tickets issued by the Platform are personal and may not be resold: resale is prohibited, and reproducing a ticket makes it invalid.

7. Image rights

Under article 9 of the French Civil Code, everyone has the right to respect for their private life, which includes the right to their own image.

Photographs and videos illustrating event pages are supplied by organisers, who warrant that they have obtained the necessary permissions from the people shown.

Anyone appearing in an image published on the Platform may request its removal at any time, without having to give a reason, by writing to legal@e-cosplay.fr. Removal will be carried out as soon as possible and the request passed on to the organiser concerned.

8. Personal data protection (GDPR)

In accordance with Regulation (EU) 2016/679 of 27 April 2016 ("GDPR") and French Act no. 78-17 of 6 January 1978 as amended on information technology, data files and civil liberties, Association E-Cosplay, as data controller, undertakes to protect the confidentiality of the personal data it collects.

You have the right of access, rectification, erasure, restriction, portability, objection, and withdrawal of consent at any time. To exercise these rights, contact the Data Protection Officer with proof of identity. You will receive a reply within one month at the latest.

9. Cookies and trackers

The Platform uses cookies strictly necessary for it to work (session, security, basket), set without prior consent in accordance with article 82 of the French Data Protection Act and CNIL guidelines, and, subject to your explicit consent, anonymised audience measurement (Zen, zen.e-cosplay.fr) and technical error monitoring (E-Monitor, monitoring.e-cosplay.fr).

No advertising cookie is set and no ad network is present on the Platform.

10. Hyperlinks

The Platform may contain hyperlinks to other websites, in particular to organisers' own sites and social media. Association E-Cosplay exercises no control over these third-party sites and accepts no liability for their content, privacy practices or policies.

Linking to https://ticket.e-cosplay.fr is free for public pages, provided the link does not harm the association's image and does not use framing or inline linking. The association reserves the right to request the removal of any link.

11. Partnerships and advertising

Partners featured on the Platform are the result of a collaboration formalised by agreement. Partner content is identified as such. The Platform carries no programmatic advertising and uses no advertising cookie.

12. Reporting unlawful content

In accordance with article 6-I-5 of the LCEN, any manifestly unlawful content published on the Platform, in particular on an event page, may be reported to the publisher at legal@e-cosplay.fr, stating: the date of the report, your identity, a description and the precise location of the content (page address), and the legal grounds on which it should be removed.

The association reserves the right to unpublish a manifestly unlawful event immediately and to suspend the account of the organiser concerned.

Abusive reports are punishable by law (article 6-I-4 of the LCEN: one year's imprisonment and a fine of €15,000).

13. Limitations of liability

Association E-Cosplay cannot be held liable for:

  • direct or indirect damage caused to the user's equipment when accessing the Platform, resulting either from the use of equipment that does not meet the requirements in section 5, or from a bug or incompatibility;
  • indirect damage (loss of business, loss of opportunity, loss of data) arising from use of the Platform;
  • interruptions, malfunctions or unavailability attributable to the hosting provider, communication networks, the payment provider or force majeure;
  • the cancellation, postponement, modification or running of an event organised by a third party, or the resulting refunds, which are the organiser's responsibility;
  • the accuracy of information published by an organiser on their event page;
  • the content of third-party sites reachable through hyperlinks.

Users remain solely responsible for how they use the Platform and the information available on it, and for keeping their tickets and login credentials safe.

14. Consumer mediation

In accordance with articles L.612-1 et seq. of the French Consumer Code, in the event of a contractual dispute with the association that could not be settled amicably, consumers may use a consumer mediator free of charge, under the conditions set out in the general terms of sale. Consumers may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Before any mediation, the consumer must send a written complaint to legal@e-cosplay.fr. Where the dispute concerns an event organised by a third party, the complaint must be addressed to that organiser.

15. Governing law and jurisdiction

This legal notice is governed by French law. Any dispute relating to the use of the Platform which cannot be settled amicably will be submitted to the competent French courts under ordinary rules of jurisdiction.
