Terms of sale

1. Identity of the Platform operator

2. Scope
These Terms and Conditions of Sale (the "Terms of Sale") apply, without restriction or reservation, to any order placed on the platform https://ticket.e-cosplay.fr (the "Platform") by a consumer or a business customer (the "Customer") relating to:
- entry tickets to an event (convention, festival, show, party, workshop);
- stand or table bookings (flea market, car-boot sale, craft market);
- participation in an online vote organised as part of a competition;
- invitations, accreditations and passes issued free of charge by an organiser.
Any order implies prior, express and unreserved acceptance of these Terms of Sale, evidenced by a tick box at the time of ordering, as well as of any specific terms of the organiser brought to the Customer's attention before payment.
3. Who sells the ticket?
The ticket is sold by the organiser of the event. Association E-Cosplay acts as a technical intermediary: it makes the ticketing service available, collects payment through its service provider into the organiser's payment account, issues the ticket and provides the entry-control tool.
Consequently:
- the organiser is solely responsible for the holding of the event, its content, its access conditions, its postponement, its modification, its cancellation and any resulting refunds;
- the association is responsible for the proper functioning of the ticketing service, the issuing of the ticket and the service it invoices to the organiser;
- where the association is itself the organiser of the event, it assumes both roles, which is indicated on the event page.
The identity and contact details of the organiser appear on the event page, on the ticket and in the confirmation email.
4. Tickets and services
Events are described by their organiser with the greatest possible accuracy (title, description, date, times, venue, prices, access conditions). Images have no contractual value. The association does not verify the accuracy of this information; any inaccuracy must be reported to the organiser, and may also be reported to support@e-cosplay.fr.
Offers are valid within the limits of the quantities put on sale. An event's ticketing opens and closes on the dates set by the organiser, displayed on the event page. Tickets may be subject to a quota per order.
Certain prices (concession, child, member, exhibitor) are subject to the presentation of supporting proof at the entrance. Failing this, access may be refused without refund, or the price difference may be required by the organiser.
5. Prices
Prices are stated in euros and displayed before the order is confirmed. The applicable price is the one in force on the day of the order.
Association E-Cosplay is not subject to VAT in respect of its non-profit activity (article 261, 7-1° of the French General Tax Code) for the ticketing service it provides to the organiser. The organiser remains responsible for the tax regime applicable to its own sales and, if it is liable for VAT, for the VAT on the price of the tickets.
The total amount payable by the Customer is displayed before payment, including any fees. No fee is added after the order has been confirmed.
6. Ordering
Orders are placed online using the so-called "double click" process (articles 1127-1 and 1127-2 of the French Civil Code):
- selection of tickets and addition to the basket;
- review of the basket summary (event, prices, quantities, total amount), with the option to correct any error;
- entry of the information required to issue the tickets (surname, first name, email address);
- acceptance of these Terms of Sale by ticking a box;
- final confirmation carrying an obligation to pay.
The selected tickets are held for a limited period (fifteen minutes) while payment is made. After that period, the order is cancelled automatically and the tickets are put back on sale.
A confirmation email setting out the essential details of the order, the tickets and the identity of the organiser is sent to the Customer. The association reserves the right to refuse or cancel any order that is abnormal, placed in bad faith, manifestly intended for resale, or in the event of a previous unresolved dispute.
7. Payment
Payment is made online by bank card, including via Apple Pay and Google Pay, through Stripe Payments Europe, Ltd., a PCI-DSS certified provider. Bank card details never pass through the association's servers and are never stored there. No other means of payment is accepted.
Payment is due immediately upon ordering. Tickets are only issued once payment has actually been received. If bank authorisation is refused, the order is automatically cancelled.
Sums are collected into the organiser's payment account, opened with Stripe. The association deducts its service commission from that transaction.
8. Issuing of tickets
Tickets are issued in electronic form, immediately after payment has been confirmed:
- as a PDF attachment to the confirmation email;
- and at any time from the order tracking page, accessible via the personal link contained in that email.
Each ticket bears a unique reference, a security key and a QR code. The Customer must present the ticket, printed or on their phone screen, at the entrance to the event.
If the email is not received within a reasonable time, the Customer should check their junk mail folder and then contact support@e-cosplay.fr: tickets can be re-sent free of charge.
9. No right of withdrawal
In accordance with article L.221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of leisure activity services to be provided on a specific date or during a specific period.
Event tickets, stand bookings and participation in a vote fall within this exception: the Customer has no right of withdrawal and tickets are neither exchangeable nor refundable, except in the cases provided for in article 10.
This information is brought to the Customer's attention before their order is confirmed.
10. Refunds
Principle: no refunds. A ticket that has been purchased is not refunded, including in the event of inability to attend, lateness, forgetfulness, loss of the ticket or refusal of access resulting from failure to comply with the event rules.
A refund is only possible in the following cases:
- Cancellation of the event by the organiser: the Customer is refunded the price of their ticket, at the organiser's initiative.
- Postponement or substantial modification of the event (date, venue, essential content): the organiser informs Customers and determines, in compliance with applicable law, whether tickets remain valid or are refunded.
- Decision of the organiser: the organiser may, at its sole discretion, grant a full or partial refund, in particular pursuant to its own specific terms.
- Error attributable to the Platform (double charge, ticket not issued despite payment being taken): the association carries out the refund.
Procedure. The refund is triggered by the organiser from its account area, or by the association in the case provided for in point 4. It is made by Stripe to the means of payment used at the time of purchase, within fourteen (14) days from the refund decision, subject to banking processing times. No refund is made in cash or to another means of payment.
Any refund request must be addressed to the organiser, whose contact details appear on the ticket and on the event page. The association has no power to impose a refund on an organiser; it may, however, forward the request and, in the event of serious and repeated failings by an organiser, suspend its account.
Where a refund is granted, the association's service commission and the payment provider's fees may be retained, which is indicated to the Customer at the time of the refund.
11. Use of the ticket
- The ticket is personal. It is issued in the purchaser's name and may not be resold for profit (article 313-6-2 of the French Criminal Code, concerning habitual resale without the organiser's authorisation).
- Each ticket allows one entry only, unless otherwise stated. The ticket is invalidated as soon as it is first scanned. Depending on the organiser's choice, leaving the venue may be final.
- Reproduction of a ticket is prohibited: if several copies of the same ticket are presented, only the first presentation is accepted.
- A lost ticket may be re-downloaded free of charge from the order tracking page. A stolen or fraudulently distributed ticket may be invalidated by the organiser.
- Access to the event is subject to the organiser's house rules (opening hours, bag checks, minimum age, dress code, prohibited items). Failure to comply may result in refusal of access or exclusion, without refund.
12. Cancellation, postponement and modification of the event
The organiser informs Customers of any cancellation, postponement or substantial modification, by email, at the address provided when ordering. The association makes the sending tool available but does not guarantee that this information is provided.
In the event of force majeure (article 1218 of the French Civil Code), the consequences are settled between the organiser and the Customer, in accordance with applicable law.
13. Liability
The association is bound by the obligations incumbent upon it in its capacity as operator of the Platform and technical service provider. It cannot be held liable:
- for the organisation, conduct, quality, safety, cancellation or postponement of an event published by an organiser;
- for information published by an organiser;
- for a refusal of access decided by the organiser or its staff;
- for abnormal use of the ticket by the Customer (reproduction, resale, loss, disclosure of the QR code to a third party);
- for non-performance due to a case of force majeure or to a failure of the payment provider.
14. Personal data
Data collected in connection with orders is processed in accordance with the privacy policy. Order data is passed on to the organiser of the event concerned, who is the controller for its own purposes.
15. Complaints, consumer mediation and disputes
Complaints. Any complaint relating to an event must be addressed to the organiser. Any complaint relating to the functioning of the Platform, the issuing of a ticket or a payment must be addressed to support@e-cosplay.fr and then, failing a satisfactory response, to legal@e-cosplay.fr.
Mediation. In accordance with articles L.612-1 et seq. of the French Consumer Code, a Customer who is a consumer may have free recourse to a consumer mediator with a view to the amicable resolution of any dispute with the association, after a prior written complaint has remained unsuccessful. The contact details of the competent mediator are provided to the Customer on request and are stated on order confirmations. The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
Disputes. Failing amicable resolution, any dispute shall be submitted to the competent French courts under ordinary rules of law. These Terms of Sale are governed by French law.
16. Modification and partial invalidity
The applicable Terms of Sale are those in force on the day of the order. If any provision is declared void, the remaining provisions retain their full validity.
