Terms of use

1. Purpose

The purpose of these General Terms of Use (the "Terms of Use") is to set out the terms on which the ticketing platform https://ticket.e-cosplay.fr (hereinafter "the Platform") is made available and the conditions governing its use.

Any access to and any use of the Platform imply acceptance of and compliance with all of these Terms of Use. Users who do not accept the Terms of Use must refrain from using the Platform.

2. Publisher

The Platform is published by the Association E-Cosplay, a non-profit association governed by the French Act of 1901 (RNA W022006988 — SIREN 943 121 517), whose full contact details appear in the legal notice.

3. Definitions

  • Platform: the website https://ticket.e-cosplay.fr, the entry-control application https://scanner-ticket.e-cosplay.fr and all of their pages and services.
  • User: any person who accesses the Platform, with or without an account.
  • Purchaser: a user who orders a ticket or a booking.
  • Organiser: an association, entity or person who publishes an event on the Platform, offers tickets for sale and is responsible for holding the event.
  • Sub-account: an account created by an organiser for a member of their team, with limited permissions.
  • Organiser Content: any item published by an organiser (title, description, artwork, prices, specific conditions).

4. Nature of the service and role of the association

The Platform is an online ticketing service. The Association E-Cosplay provides the technical tool: offering tickets for sale, collecting payments through its service provider, issuing tickets and controlling entry.

The association acts as a technical intermediary. It does not organise the events published by third parties and is not a party to the contract of sale concluded between a purchaser and an organiser, except where it is itself the organiser of the event, which is then stated on the event page.

Organisers are further subject to the organiser terms, which supplement these Terms of Use.

5. Access to the Platform

Browsing the Platform is free of charge for any user with internet access. All costs relating to access (equipment, connection) remain payable by the user.

The association implements reasonable means to ensure quality access, without any obligation to achieve a specific result. Access may be suspended at any time, without notice, for maintenance, updates, security or force majeure (article 1218 of the French Civil Code), without the association incurring any liability.

The recommended technical specifications appear in the legal notice. The entry-control application requires a device equipped with a camera and permission to access it.

6. User account

  • Creating an account requires accurate, complete and up-to-date information (surname, first name, email address). A ticket may also be purchased without creating an account, in which case the order is tracked by means of a personal link sent by email.
  • Login credentials are strictly personal and confidential. Users are responsible for all activity carried out from their account and undertake to report any unauthorised use without delay to support@e-cosplay.fr.
  • An organiser account is subject to approval by the association and to the identity verification required by the payment service provider. The association may refuse an application to open an account without having to give reasons.
  • An organiser may create sub-accounts for their team and remains responsible for their actions as well as for the scope of the permissions granted to them.
  • The association reserves the right to suspend or delete, after notification, any account in the event of a breach of these Terms of Use or of the organiser terms, of fraud, or of conduct harmful to the Platform, to purchasers or to third parties. Where there is a serious and immediate risk, suspension may be immediate and notification concurrent.
  • Users may delete their account at any time; the data is then processed in accordance with the privacy policy, subject to statutory retention obligations, in particular accounting obligations.

7. User obligations

Users undertake:

  • to use the Platform in accordance with its intended purpose and with applicable regulations;
  • not to infringe the rights of third parties (copyright, image rights, privacy, trade marks);
  • not to publish content that is unlawful, defamatory, insulting, discriminatory, violent or contrary to public order;
  • not to disrupt the operation of the Platform: intrusion, mass data extraction, circumvention of security measures, use of robots, automated ticket booking;
  • not to reproduce, forge or resell a ticket, or attempt to circumvent entry control;
  • not to impersonate a third party, or use a means of payment of which they are not the holder.

Any breach may result in the cancellation of the orders concerned, the deletion of the content, the suspension of the account and, where applicable, legal proceedings.

8. Organiser content

By publishing Organiser Content on the Platform, the organiser warrants that they hold the necessary rights and authorisations and grants the association a non-exclusive, royalty-free and worldwide licence to host, reproduce and display that content, strictly limited to the operation of the Platform, the sending of emails relating to orders and the promotion of the event concerned, for the duration of its publication.

The association acts as a host of Organiser Content within the meaning of article 6 of the LCEN (the French Act on confidence in the digital economy). Any manifestly unlawful content may be reported using the procedure described in the legal notice.

9. Intellectual property

The elements of the Platform (structure, texts, interfaces, logos, images, development work, databases) are protected by the French Intellectual Property Code. Any unauthorised reproduction or display constitutes infringement (articles L.335-2 et seq.). See the legal notice.

10. Personal data and cookies

Personal data processing operations are described in the privacy policy; the use of trackers is described in the cookie policy.

11. Liability

The association may not be held liable for:

  • damage resulting from the unavailability of the Platform, from a technical malfunction or from an event of force majeure;
  • indirect damage (loss of opportunity, loss of data) connected with the use of the Platform;
  • the organisation, running, postponement, modification or cancellation of an event published by an organiser;
  • Organiser Content, subject to its obligation to remove manifestly unlawful content that has been notified to it;
  • the content of third-party websites accessible via hyperlinks.

The optional drafting assistant offered to organisers makes suggestions that must be checked and approved: the organiser remains solely responsible for the content they publish.

12. Ticket sales

The sale of tickets, of stand bookings and of participations in a vote is governed by the general terms of sale, which prevail over these Terms of Use in all matters concerning orders, refunds and the use of tickets.

13. Amendments to the Terms of Use

The association may amend these Terms of Use at any time. The applicable version is the one in force on the day the Platform is used. Users holding an account are informed of any substantial amendment by email or upon their next login.

14. Partial invalidity

If any provision of the Terms of Use is declared void or unenforceable, the remaining provisions retain their full validity.

15. Governing law and disputes

These Terms of Use are governed by French law. In the event of a dispute and failing an amicable settlement (written complaint to legal@e-cosplay.fr), the dispute shall be brought before the competent French courts. Consumers may have recourse to consumer mediation under the conditions provided for in the general terms of sale.
